07/16/2010 - NC/SC Implements BEST OFFER Disposition Strategy
NC/SC HUD has announced the implementation of the Best Offer Disposition Strategy. This is a limited time offer and you must move quickly. Properties that are eligible will be marked with "MAKE AN OFFER". Depending on the Net to HUD, the sale may be required to close in thirty (30) calendar days of contract execution, and if a single extension is granted, the maximum time is 15 calendar days at a cost of $25 per day ($375)regardless of sales price. The Selling Agent will be verbally contacted with instructions on completing the Sales contract. Procedures for placing the electronic bid are the same as any other bid.

Effective immediately the closing costs from line 5 of the contract cannot be used to pay third party closing agents. If the buyer desires to use their own attorney they will be responsible for that expense.

10/22/2009 - SPECIAL LEAD BASE PAINT ANNOUNCEMENT October 22, 2009
Effective October 20, 2009 HUD properties will no longer be sold as insurable if the lead base paint inspection denotes paint that requires stabilization in an amount greater then $4,000 (except 203K), at which point a credit will be issued to the buyer’s up to the $4,000. On all properties constructed before 1978 HMBI will order a lead-based inspection and visual assessment after the property goes under contract. This requirement only applies to those properties where the purchaser is utilizing FHA financing. If the lead-based paint inspection and associated stabilization exceeds $4,000, HMBI will notify the broker and/or agent and advise them accordingly of the following options: 1) Amend the contract financing to conventional or 203K. If the purchaser(s) opt for 203K, HUD will only approve a credit up to the $4,000. 2) Cancel the contract in accordance with the LBP Stabilization Addendum. In the cases where HUD cancels the contracts due to the presence of deterioted lead-based paint and the cost estimate for implementing the stabilization plan exceeds $4,000, the buyer shall be entitled to a 100% refund of the earnest money deposit.

Effective September 8, 2008, The Atlanta Homeownership Center has approved the use of the following Owner Occupant Sales Allowance:

08/27/2008 - UPDATE: $100 Down Payment for Owner Occupants
The $100 Down offer applies if the purchase price is less than or equal to the appraised value of the property. If the purchase price is greater than the appraised value, the purchaser may obtain a new FHA appraisal to support the higher mortgage amount or must pay cash in the amount of the difference between the appraisal and the price less $100.

09/12/2007 - Indiana statewide tax reassessment
Due to the recent statewide tax reassessment in Indiana, many townships may be experiencing backlogs in their daily work, including title transfer.

You may experience a closing delay due to this backlog which is out of the control of HUD and HMBI.

You may wish to contact the County office that is responsible to handle the transfer for a case address to confirm if the backlog may affect this property.

08/27/2007 - Important News: HUD No longer requires an engineering certificate on HUD sales to obtain FHA Financing in Illinois, Indiana, North Carolina and South Carolina.
Starting immediately an engineering certification is not required on HUD homes that are in the active inventory and offered for sale. Owner occupant purchasers may now use FHA financing on any manufactured homes that meet the other eligibility requirements as 203B, 203K and 203K streamlined financing products from HUD. In order to facilitate the change all manufactured homes will be placed on a bid period starting 8/24/07 to allow owner occupant purchasers the opportunity to purchase these homes.

09/18/2006 - NEW CLOSING COST GUIDELINES
HUD has issued Notice H-2006-12 in replacement of Notice H-2005-12: For all contracts executed on or after October 12, 2006, HUD will pay up to (and may not to exceed) 3% of all closing costs considered to be reasonable and customary in the jurisdiction where the property is located. If the total closing costs reflected on the HUD-1 settlement statement are less than the amount indicated on the sales contract, HUD will reimburse only the actual costs charged and will not credit the purchaser with any difference either in cash or through a reduced purchase price. Within the three percent (3%) allowance, HUD will reimburse loan origination fees up to one percent of the mortgage. However, on an FHA 203(k) rehabilitation mortgage loan, HUD will reimburse one and a half percent (1.5%) of the mortgage. Click here to review HUD Notice H-2006-12.

For those that have executed contracts, HUD has temporarily suspended closing activity with Lakeside Title in North Carolina due to contractual issues. We are currently working with Lakeside to ensure that they are in compliance and we are confident that this will be resolved in the very near future. In the interim we have arranged for Peter Chastain, our former closing agent, to accommodate closings that require immediate attention. For those whose contracts have not been executed we have instructed HMBI to not execute any further contracts until we can resolve this situation.
